TERMS OF SERVICE
Welcome to Rene & Hans Advocates LLP. These Terms of Service govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.
1. Engagement & Scope of Role
By engaging Rene & Hans Advocates LLP, clients agree that:
➝ A partner will be assigned to oversee your legal needs.
➝ The scope of legal work will be defined and agreed upon as the engagement progresses.
➝ The firm provides legal services only (not financial or business advice unless expressly agreed).
➝ Instructions will be accepted from individuals within the client organization who appear to have authority, unless directed otherwise.
2. Conflict of Interest
➝ The firm may represent other clients (including competitors) on unrelated matters unless it has been engaged on the specific matter in conflict.
➝ Ethical walls will be maintained to protect confidentiality.
3. Fees & Disbursements
➝ Fees are based on the Advocates Remuneration Order or pre-agreed arrangements.
➝ Clients may be required to pay deposits before commencement of legal services. >br>
➝ Fees may consider time, experience, urgency, and outcome. >br>
➝ VAT is charged on all services and disbursements.
➝ Monthly billing is standard; unpaid accounts after 30 days may accrue interest.
4. Third-Party Providers
➝ Clients are responsible for costs of any experts or foreign legal advisors engaged on their behalf.
5. Termination
➝ Either party may terminate the engagement in writing.
➝ Upon termination, unpaid legal fees and disbursements become immediately payable.
➝ Documentation can be returned upon request; otherwise, storage or disposal is subject to firm policy.
6. Document Retention
➝ Files will be kept as required by statute, after which they may be destroyed unless instructed otherwise.
➝ Charges may apply for retrieval or reproduction of archived documents.
7. Limitation of Liability
➝ Professional indemnity is covered up to Ksh 50,000,000.00 by Africa Merchant Assurance Company Kenya Limited.
➝ The firm may hold directors personally liable for fees in the case of client company insolvency.
